A group of 230 small shareholders of Banco Espírito Santo (BES) presented a precautionary measure to block the sale of the New Bank, known as the "Chinese business", to the Administrative Court of the Círculo de Lisboa. The injured people represented by the law firm Miguel Reis & Associados question where the provision was aimed at reimbursing clients who invested in commercial paper from GES to the branches of BES and advance against the Bank of Portugal because they believe that the banking supervision entity made a "Assault" and a "confiscation" of Banco Espírito Santo in appropriating amounts and assets that should be used to pay the injured parties.

Weighing on the sale is also a series of court challenges related to the resolution of Banco Espírito Santo. On Friday, Novo Banco had a partial win in one case involving an $835 million loan from Oak Finance Luxembourg SA, a vehicle arranged by Goldman Sachs Group Inc., to Banco Espírito Santo. When the lender collapsed, Bank of Portugal said it would move the loan to Novo Banco, but it later backtracked and said the loan belonged to the “bad bank.”

RELEASE CONCERNING THE WITHDRAWAL OF BES’ BANKING AUTHORISATION
Pursuant to and for the purposes of article 1, item d), of CMVM’s regulation no. 5/2008, Banco Espírito Santo, S.A. (“BES”) informs that the European Central Bank notified BES,

on the 13th of July of 2016, of its decision to withdraw BES license for the pursuit of banking activity.
The decision to withdraw BES’ authorisation involves the dissolution and commencement of the liquidation of the bank, in line with numbers 1 and 2 of article 5 of Decree-Law no. 199/2006, of August 14, and the withdrawal of the authorisation produces the effects of the declaration of insolvency.
The next steps are as follows:
(i) Banco de Portugal shall request, under the applicable law, before the competent court, the commencement of BES’ judicial liquidation, and that request will be forwarded together with Banco de Portugal’s proposal for the appointment of a judicial liquidator or a liquidation committee, to be appointed by the judge;
(ii) The judge will then issue its order for the judicial liquidation to proceed and appoints the liquidator or the liquidation committee;
(iii) Only after the judge’s order will the subsequent steps of the judicial liquidation proceeding ensue, which will be governed by the provisions of Decree-Law no. 199/2006, of August 14 and, subsidiarily, by the provisions of the Portuguese Insolvency and Corporate Recovery Code.

Yeah and I was watching L2 when they were going thru and the 10k blocks were pretty much 10k or maybe a few more shares behind them but they fell fast. Right now 70k 001 and 66k 0014 then 10k 002 and I believe that is about all that is there too. Few if any hidden shares here.

Agreed on both points. Funds holding millions of shares of this before August, 2014 cannot sell this time and it could very well be a write down for them.

Institutions did purchase this after the resolution; Morgan Stanley and Citigroup have accumulated a large number of shares but a lot has changed since they purchased the shares.

Like I said in my previous post, a lot has changed on the BES balance sheet in the last two years. The Bank of Portugal has pushed more liabilities into BES to make Novo Banco more attractive for a sale. Hopefully, some of those transfers will be overturned in court but it's a long shot at best.

Apologies for the bad examples as the tickers I cited did have the "Q" assigned. This has already traded almost two years after the Bank of Portugal resolution measures so it remains to be seen what will be done after the license is revoked.

Yup but tying the sale of Banco Novo to this one and implying that institutions are buying this are outright lies. Mutual funds & institutions are bagholders. Not SUGGesting in any way, shape or form you are doing that, but that was the tone of the board.

Thank you and I agree, this ticker could be suspended pending the license revocation. I've seen stocks like this trade on for years doing a liquidation; TWKGQ? Trenwick Group along with LaSalle an insurance company that was slowy wind down for years comes to mind, and others are not so lucky.
