MsABA found a unique conference;

That THJW will be attending/presenting and may well have
accidentally missed a day when he scheduled the 6/28 follow-on session to finish hearing the JMOL arguments.

This conference explains to my satisfaction the things I observed about the sidebar.

I posted this on the hyena board, in reply to M t Sugawa post embedded.

Hmmm,
THis conference may very well have been the topic of the last minute sidebar.
I thought I heard 'disclose' and
read the court's body language and facial color as apologetic.
I thought I heard Stone say 'sorry', as if
to say he was sorry their case had caused the court to miss something.
As the sidebar was ending I thought I heard the court expressing some amazement that the thing being discussed could have been overlooked by the court.
So, I'm relieved that there is nothing more worrisome lurking in that sidebar. I was afraid it was some kind of delay, but now I think I understand. The (stale)paper schedule outside courtroom 4 yesterday said judge unavailable
and some jokes were made about whether we were confused about the time of the continued hearing.
Apparently we were not the ones confused about where THJW was expected to be...

I find it very interesting, perplexing and a bit disturbing to get this exact group of people together.

We all know about the panelists, Whyte and Jordan. However, it's interesting that the Deputy General Counsel from Micron, Joel Poppen, is also on the panel. Also, the moderator of this discussion panel is none other than Frederick Cottrell, the lead counsel representing Micron in the Rambus v Micron case in Delaware in front of Judge Jordan!?!?

This is too much of a coincidence for me! If it were Payne on the panel, then we'd all be screaming bloody murder.
