NEC DEFENDANTS’ UNOPPOSED MOTION FOR EXTENSION OF TIME TO FILE AMENDED ANSWERS, AFFIRMATIVE DEFENSES AND COUNTERCLAIMS
COMES NOW Defendants NEC Corporation, NEC Electronics America, Inc., NEC Display Solutions of America, Inc., NEC Corporation of America, and NEC Unified Solutions, Inc. ("the NEC Defendants") seeking the Court's permission for a further extension of time to serve their Amended Answers, Affirmative Defenses and Counterclaims from February 16, 2007 to February 21, 2007.This modification is not being sought for the purpose of delay, but only to give the parties more time to fully consummate a settlement involving some, but not all, of the NEC Defendants. Plaintiffs have agreed to this Motion. WHEREFORE, the NEC Defendants respectfully pray that the Court grant this Motion and permit the extension of time for the NEC Defendants to serve their Amended Answers, Affirmative Defenses and Counterclaims from February 16, 2007 to February 21, 2007. A proposed Order granting this Unopposed Motion is attached for the Court's convenience.
